1. Acceptance of Terms
By accessing or using the XentiQ AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. XentiQ AI reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you are not prohibited from using the Service under any applicable law or regulation. You are responsible for ensuring that your use of the Service complies with all laws applicable to you in your jurisdiction.
3. Account Registration
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify XentiQ AI immediately of any unauthorized use of your account.
4. Service Description
XentiQ AI provides an AI-powered crypto trading platform that includes automated trading algorithms, smart capital allocation across multiple entry levels, a reserve-buffer mechanism, and analytical tools based on the Law of Large Numbers. The Service connects to third-party cryptocurrency exchanges via API. XentiQ AI does not hold, custody, or control your cryptocurrency assets. All assets remain on your chosen exchange at all times.
5. API Access and Exchange Connections
To use the Service, you must provide API keys from supported cryptocurrency exchanges. You agree to grant only "read" and "trade" permissions — never "withdrawal" permissions. XentiQ AI will never request withdrawal access to your exchange accounts. You are responsible for properly configuring API permissions on your exchange account. XentiQ AI is not liable for any losses resulting from improperly configured API permissions.
6. Trading and Financial Risks
Cryptocurrency trading involves substantial risk of loss. Past performance is not indicative of future results. AI-generated trading signals and automated strategies do not guarantee profits. You acknowledge that: (a) cryptocurrency markets are highly volatile; (b) you may lose some or all of your invested capital; (c) XentiQ AI does not provide financial, investment, tax, or legal advice; and (d) you are solely responsible for your trading decisions and their outcomes. 7. Reserve Buffer
The XentiQ AI reserve buffer is a risk-management mechanism that allocates a portion of trading profits into a reserve pool. This buffer is designed to help cushion drawdowns during adverse market conditions when reserves are available. It is not a guarantee against loss, is not government-insured, and should not be confused with traditional insurance products. The buffer operates according to the parameters set by the system and may not fully offset losses in all market conditions.
8. Fees
XentiQ AI may charge fees for use of the Service. All applicable fees will be disclosed before you incur them. Fees are subject to change with prior notice. Third-party exchanges may also charge their own trading fees, withdrawal fees, and other costs, which are separate from and in addition to any XentiQ AI fees.
9. Prohibited Conduct
You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable law or regulation; (b) attempt to manipulate, exploit, or interfere with the Service's algorithms or infrastructure; (c) use the Service for money laundering, terrorism financing, or other financial crimes; (d) reverse engineer, decompile, or disassemble any part of the Service; (e) share your account credentials with third parties; (f) use automated tools to scrape or extract data from the Service; or (g) misrepresent your identity or affiliation.
10. Intellectual Property
All content, features, algorithms, software, and technology comprising the Service are the exclusive property of XentiQ AI or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works based on the Service without prior written consent.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. XentiQ MARKETS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION OBTAINED FROM XentiQ MARKETS SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XentiQ MARKETS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL XentiQ MARKETS' TOTAL LIABILITY EXCEED THE AMOUNT OF FEES PAID BY YOU TO XentiQ MARKETS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless XentiQ AI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Termination
XentiQ AI may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting supportxentiqai@gmail.com. Termination does not relieve you of any obligations incurred prior to termination.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of a mutually agreed arbitration body. You agree to waive any right to a jury trial or to participate in a class action.
